Terms of Service
These Terms of Service are an agreement between you and The Code Craft LLC, doing business as Focus Badger, and govern your access to and use of the Web app, Desktop app, subscriptions, downloads, and related services.
1. Agreement and eligibility
By creating an account, starting a subscription, downloading or installing the Desktop app, or otherwise using Focus Badger, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.
If you use Focus Badger for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
2. The service
Focus Badger is a productivity and screen-time service. Depending on the features you enable, it can apply Blocking rules to selected apps and website domains, synchronize Focus sessions, shape spoken or typed focus intent into Session todos, and interrupt access to selected distractions.
The Desktop app requires certain macOS permissions to provide these features. You control those permissions in System Settings. Revoking a required permission or preventing the app from running may make part of the service unavailable or inaccurate.
Focus Badger provides productivity tools, not medical, mental-health, employment, legal, or financial advice, and does not guarantee performance or outcomes.
3. Accounts and sign-in
You sign in through Google or Apple. You are responsible for maintaining the security of that provider account and for activity under your Focus Badger account. Tell us promptly if you believe your account has been compromised.
You must provide accurate information and may not impersonate another person, create an account for someone without permission, transfer an account, or use the service after we have suspended your access.
4. Subscriptions, trials, billing, and cancellation
Focus Badger uses a hard paywall. Except for any trial or promotional entitlement we expressly offer, an active paid subscription is required to use the service beyond account access and Settings.
Paid plans renew automatically at the price and billing interval shown at checkout until canceled. Prices may exclude taxes. Stripe securely processes payment information and provides the billing-management portal, and RevenueCat helps administer purchases and entitlements. Their terms may also apply to their services. Focus Badger does not store full payment-card numbers.
A free or discounted trial converts to the paid plan disclosed at checkout unless you cancel before the trial ends. We may limit trial eligibility and may end abusive or duplicate trials.
You can manage or cancel your subscription from Settings, which opens Stripe's secure billing-management portal. Cancellation stops future renewals but normally remains effective through the end of the paid period. Deleting the app or your account does not by itself cancel a subscription; use the billing-management flow or contact us if it is unavailable.
We may change future subscription prices after giving any notice required by law. A price change applies no earlier than your next renewal after the notice period. You may cancel before that renewal.
5. Refunds and digital-service withdrawal
Except where applicable law requires otherwise, purchases are final and non-refundable once you have installed and first run the Desktop app. Downloading or installing the app without running it does not trigger this rule.
By purchasing paid access and beginning to use Focus Badger, you expressly request immediate performance and delivery of the digital service. To the fullest extent permitted by law, you acknowledge that your statutory right to cancel or withdraw and receive a refund ends once that performance or digital delivery begins. This does not waive any right that applicable law says cannot be waived.
Canceling a subscription stops future renewals but does not retroactively refund an earlier charge or the current billing period. We do not provide credits for partial periods, unused time, failure to quit the app, or dissatisfaction with an insight or estimate.
These restrictions do not exclude refunds or remedies required by consumer-protection law, including for a service that is materially defective or not as described. If you believe a mandatory right applies, contact us with the account email, purchase date, and reason for the request.
6. License and acceptable use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Desktop app and access the Web app for their intended purpose while these Terms apply.
- Do not reverse engineer, decompile, bypass technical limits, or extract source code except to the limited extent applicable law expressly permits.
- Do not copy, sell, sublicense, rent, distribute, or commercially exploit the service or our content without written permission.
- Do not interfere with the service, probe for vulnerabilities, introduce malware, automate abusive traffic, or evade access, entitlement, or security controls.
- Do not use Focus Badger to monitor another person or a device you do not control without all notices, permissions, and lawful authority required in your jurisdiction.
- Do not use the service unlawfully or in a way that infringes another person's privacy, intellectual-property, or other rights.
7. Your content and feedback
You retain rights in content you provide, such as focus intent, Session todos, onboarding answers, and blocking preferences. You grant us a worldwide, non-exclusive license to host, process, transmit, and display that content only as reasonably necessary to operate, secure, support, and improve the service.
If you send suggestions or feedback, you allow us to use it without restriction or compensation, but we do not acquire ownership of your pre-existing content.
8. Privacy and device permissions
The Privacy Policy explains what we collect and how we use and disclose it. Desktop Enforcement processes the active app or supported-browser domain locally when deciding whether to apply one of your Blocking rules. Focus Badger does not upload general foreground-app history, browsing activity, window titles, screenshots, or keystrokes for reporting.
You must not install or operate Focus Badger on a shared, employer-owned, school-owned, or third-party device unless you have authority to do so and have given any notices or obtained any consents required by law or policy.
9. Our ownership
Focus Badger and its software, design, branding, documentation, reports, and other service materials are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license above, these Terms grant you no ownership right in the service.
10. Third-party services
Focus Badger relies on third-party services such as Google, Apple, Supabase, Stripe, RevenueCat, hosting and infrastructure providers, and AI providers. We do not control their services, availability, or independent data practices. Your use of a third-party service may be governed by its own terms and privacy policy.
11. Changes, availability, and termination
We may add, change, suspend, or discontinue features. We will give notice when required by law and will not use this clause to avoid obligations for a paid service already provided. Updates may be required for security or compatibility.
You may stop using the service at any time and may request account deletion by emailing hello@focus-badger.com from the email address associated with your account. Self-service account deletion is planned but not currently available. Account deletion does not itself cancel a subscription, so cancel through Settings before requesting deletion.
We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay, or misuse the service. Sections that by their nature should survive—including payment obligations, ownership, disclaimers, liability limits, and dispute terms—survive termination.
12. Disclaimers
To the maximum extent permitted by law, Focus Badger is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted or error-free operation, that blocking will prevent every distraction, or that reports will be complete or perfectly accurate.
Nothing in these Terms excludes an express warranty or consumer guarantee that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, neither Focus Badger nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunity arising from the service.
To the maximum extent permitted by law, our total liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid Focus Badger in the 12 months before the event giving rise to the claim or US $100. These limits do not apply to liability that cannot legally be limited, which may include fraud, willful misconduct, or personal injury caused by negligence in some jurisdictions.
14. Indemnity
If you use Focus Badger on behalf of a business, you will defend and indemnify Focus Badger from third-party claims arising from that business's unlawful use of the service, violation of these Terms, or monitoring of a person or device without required authority or notice. This section does not apply to individual consumers where prohibited by law.
15. Applicable law and disputes
The laws of the State of Connecticut govern these Terms and any dispute, without regard to conflict-of-law rules. Except where mandatory law permits another forum, any dispute must be brought in the state courts located in Hartford County, Connecticut, or the United States District Court for the District of Connecticut.
Nothing in these Terms deprives you of mandatory consumer protections or the right to bring a claim in a court or forum that applicable law makes available to you. Before filing a formal claim, please contact us and give us 30 days to try to resolve it informally, unless a limitations period or urgent relief requires earlier action.
16. Changes to these Terms
We may update these Terms as the service or law changes. We will post the updated version and revise the effective date. If a change materially reduces your rights, we will provide additional notice when required. Your continued use after the new Terms take effect means you accept them, to the extent permitted by law.
